1. What AccessHawk is
AccessHawk provides automated website accessibility scanning and reporting ("the Service"), operated by Nighthawk Marketing ("we"). The free scan is provided as-is, for informational purposes. Paid monitoring subscriptions are governed additionally by the order form or invoice under which they were purchased.
2. No certification, no legal advice
Reports are generated by automated analysis and identify a subset of potential WCAG 2.1 AA failures. A report — including a high score — is not a certification of compliance with WCAG, the ADA, Section 508, or any law, and is not legal advice. Compliance determinations require human expert review and, where it matters, your counsel. We make no warranty that use of the Service will make any website compliant or prevent any complaint, enforcement action, or lawsuit.
3. Acceptable use
You may scan websites you own, operate, or have authority to assess, and public government websites for readiness-assessment purposes. You may not use the Service to harass website operators, to generate legal demand letters at scale, to probe for exploitable vulnerabilities, or in any way that violates law. We may rate-limit, block, or refuse scans at our discretion to protect the Service and scanned sites.
4. Your content
Reports you generate are yours to use, print, and share. Shared report links are public to anyone holding the link and expire automatically after 180 days. We may use aggregate, non-identifying statistics (e.g., "the average city homepage has N issues") publicly; we will not name your entity without permission.
5. Liability
To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind, and our total liability arising from the free Service is limited to $100; for paid subscriptions, to the fees paid in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including legal exposure arising from reliance on any report.
6. Monitoring subscriptions
Paid plans are annual, invoiced in advance, and renew upon mutual agreement — no auto-renewal surprises for public budgets. Either party may terminate for material breach on 30 days' written notice. Government entities: nothing in these terms waives sovereign immunity or conflicts with mandatory state procurement law; where your jurisdiction requires different terms, we'll negotiate them in the order form.
7. Changes
We may update these terms; the date below changes when we do. Continued use after a change is acceptance. Material changes to paid subscriptions will be communicated directly.
